Terms of Service — Fetchy

Welcome to Fetchy. These Terms of Service (“Terms”) govern your use of fetchy.pk and the products and services offered by Fetchy (“Fetchy,” “we,” “us,” or “our”). By visiting our website or placing an order, you agree to these Terms. If you do not agree, please do not use our website or services.

1. Scope

These Terms apply to browsing, purchases, returns, exchanges, promotions, and communications with Fetchy. Our Shipping Policy, Return & Refund Policy, and Privacy Policy also apply to your use of our website and services.

2. Eligibility

By placing an order, you confirm that you are legally able to enter into a binding agreement under applicable law. If you are placing an order on behalf of another person, you confirm that you are authorized to do so.

3. Accounts and Security

If you create an account, you agree to provide accurate information and keep your login credentials secure. You are responsible for activity carried out through your account. Please notify us promptly if you suspect unauthorized access.

4. Orders and Acceptance

All orders are subject to product availability and confirmation by Fetchy. We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of stock shortages, incorrect pricing, suspected fraud, or inaccurate order information. If we cancel an order after payment has been collected, we will arrange an applicable refund and notify you.

5. Pricing and Payment

All prices are displayed in Pakistani Rupees (PKR), unless otherwise stated. Prices and promotions may change without prior notice, but changes will not affect an order already accepted unless required by law or agreed with the customer.

Available payment methods, including Cash on Delivery (COD) where offered, will be displayed during checkout. For COD orders, payment is due when the parcel is delivered, in accordance with the courier's delivery procedure. For prepaid orders, payment must be completed through the payment method offered at checkout.

Any additional charges applicable to an order will be disclosed before the order is placed, where required.

6. Taxes and Duties

Applicable taxes will be handled in accordance with Pakistani law. Customers ordering from outside Pakistan, if international orders are offered, may be responsible for import duties or other charges imposed by their jurisdiction.

7. Product Information

We make reasonable efforts to ensure that product descriptions, photographs, colors, prices, and size guides are accurate. Actual colors may appear slightly different depending on screen settings, and minor variations in fabric texture or fit may occur. Please review the product description and size guide before placing an order.

If a product is materially different from its description, defective, or incorrectly supplied, please contact us in accordance with our Return & Refund Policy.

8. Shipping and Delivery

Fetchy offers delivery within Pakistan to serviceable locations. Shipping charges, order processing information, and estimated delivery times are described in our Shipping Policy and, where applicable, at checkout.

Delivery dates are estimates and may be affected by courier operations, weather, public holidays, or other circumstances beyond our reasonable control. If your order is delayed or appears to be lost, please contact our support team so we can assist you.

9. Returns, Exchanges, and Refunds

Returns, exchanges, and refunds are handled in accordance with our published Return & Refund Policy. Eligible requests must be submitted within the stated return period and may require the order number and photographs of the item.

Refund eligibility, inspection requirements, return-shipping responsibility, and processing time are explained in that policy. For COD orders, our support team will confirm the available refund arrangement and any information needed to process it.

Nothing in these Terms is intended to exclude consumer rights that cannot lawfully be excluded.

10. Order Cancellations

You may request cancellation within 12 hours of placing your order, provided the order has not already been dispatched or entered a stage where cancellation is no longer possible. Contact support as soon as possible. If the parcel has already been dispatched, our Return & Refund Policy will apply.

11. Promotions and Discounts

Promotional offers and discount codes may have specific eligibility requirements, expiry dates, or other conditions. These will be communicated with the relevant offer. Fetchy may withdraw or correct an offer issued in error or used fraudulently, subject to applicable law.

12. Intellectual Property

Content on fetchy.pk, including logos, product photographs, text, graphics, and designs, belongs to Fetchy or its respective licensors unless otherwise stated. You may not reproduce, distribute, or commercially use this content without prior permission, except where permitted by law.

13. User Content and Reviews

If you submit a review, photograph, or other content to Fetchy, you confirm that you have the right to share it and that it does not violate another person's rights or applicable law.

You grant Fetchy a non-exclusive, worldwide, royalty-free license to use, reproduce, and display the submitted content for purposes related to our website, products, and marketing, subject to applicable law. You may contact us if you have concerns about the use of your content.

14. Limitation of Liability

To the extent permitted by applicable law, Fetchy will not be liable for indirect or consequential losses arising from the use of our website or services. Nothing in these Terms excludes liability that cannot legally be excluded or limits any mandatory consumer rights.

15. Misuse of the Website

You must not use our website for unlawful activities, fraudulent orders, unauthorized access, or conduct that interferes with the website's operation. We may take reasonable steps to address suspected misuse, subject to applicable law.

16. Suspension and Termination

We may restrict access to an account or website feature where reasonably necessary to address fraud, security risks, unlawful activity, or a breach of these Terms. Any existing customer rights or obligations will remain subject to applicable law.

These Terms are governed by the laws of Pakistan. Disputes will be handled by the courts or other forums with appropriate jurisdiction under applicable law.

We may update these Terms from time to time. The Effective Date above indicates when this version was last updated. Changes will apply from the date they are published, subject to applicable law.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
